In commercial real estate, properties are often held under business entities. Here’s how to handle the transfer process:

1. If Property is in Individual Name:
Transfer proceeds through a standard sale deed and mutation process.

2. If Property is Owned by a Company:

  • Board resolution authorizing sale is required
  • Company’s incorporation certificate and NTN must be submitted
  • Director/authorized person signs documents

3. If Transferring Within a Partnership:

  • Update the partnership deed and Form-C from the registrar
  • Clearly state asset re-allocation or buy-out terms
  • Pay applicable stamp duty for internal title transfers

Important: Make sure the transferee is properly documented in land and taxation records to avoid future ownership challenges.
